Lawsuit case study. How does this violate Fair Use
Art AI is undergoing a classaction lawsuit. "AI needs to be fair and ethical for everyone," said lawyer/programmer Matthew Butterick. "But Stability AI, Midjourney, and DeviantArt are appropriating the work of thousands of artists with no consent, no credit, and no compensation...""As burgeoning technology continues to change every aspect of the modern world, it's critical that we recognize and protect the rights of artists against unlawful theft and fraud," said Joseph Saveri, founder of the Joseph Saveri Law Firm, LLP. The attack of artists rights are being compared to the music industries fight on Napster when music was shared without artists consent and compensation. Greg Rutkowski, are annoyed that Stable Diffusion and other image generating models were trained on their artwork without their consent and can now reproduce their styles.

Appropriation Starts in Art
Marcel Duchamp 1917 changes the definition of art. Art can be about the fact that this is an interesting shape and sculpture. Taken out of its normal environment, the bathroom, this urinal is raised to art when it gets placed in a gallery on a pedestal.
We change its meaning = appropriation. This leads to the pop art movement in the 1960s art from billboards, advertisements, comic books, and advertising become artwork as soon as they llikewise are hung on gallery walls.

Pop Art - Andy WarholPop Art looked at the world at large with comic books, soup cans and everyday items and glarmorized what is in our world. It allowed art to use these items as inspiration. Today artists borrow or appropriate images from movies, cartoons, package design, and ads to create art. They change the meaning of art being a label on a can of soup to becoming appropriated into a piece of art hung on a wall.
Warhol had used a copyrighted photograph of flowers to make this artwork. He was sued for a portion of the profits, and two paintings. He was not sued for the Campbells soup can because he wasn't hurting the soup industry in doing so, if nothing else it was helpful.

Appropriation in art is the use of pre-existing objects or images with little or no transformation applied to them. The use of appropriation has played a significant role in the history of the arts (literary, visual, musical and performing arts).

Cultural Appropriation
Cultural appropriation, at times also phrased cultural misappropriation, is the adoption of elements of one culture by members of another culture. This can be controversial when members of a dominant culture appropriate from disadvantaged minority cultures. It takes something revered by one culture and it becomes used as a prop, or fashion or changed in meaning by another culture. The videoTomahawk chop. Indians petition non-Indian football leagues to not use things from their culture. Another example is the Washington Redskins. Culture appropriation should never be done. During the 2020 Shakira did a tongue wag that sounded middle eastern. She took heat until people realized that she is actually part Lebonese aka middle eastern. That of course is know being reinvented and parodied That is part of her culture and she can do what she wants in terms of her own identity. |

Can art rewrite history
Parody changes makes fun of the original - Commercial
The original Ground Hog Day. The 2020 Superbowl was played on 02/02/2020 ground hogs day. Jeep altered the original 1993 movie and kept much the same in its superbowl ad (factoid: 5 million dollars for a 30sec ad and this ad was almost 60sec). Watch the movie trailer and compare it to the commercial.
DISCUSSION What is the message of the first video? What is the message of the second? What did the creator of Jeep do differently? is it a copy? is it an original thought?
